The Supreme Court has ruled that an inspector’s report into the underpayment of Turkish workers while the construction of the Ennis Bypass was underway will be given to the state and other bodies but may not be published generally.
The decision quashes a High Court ruling the report could not be circulated beyond the office of the Minister for Enterprise, Trade and Employment.
The report into the underpayment and mistreatment of Gama workers on the Ennis Bypass was conducted by an inspector for the Minister of Enterprise, Trade and Employment.
In 2005, a High Court judge ruled that the inspector had acted outside his powers in dealing with the report and that it not be circulated any further.
The office of the Minister appealed the decision to the Supreme Court and yesterday, a ruling was given quashing the High Court decision.
The five-judge Supreme Court found the report, may be circulated to bodies including the Competition Authority, Departments of Finance and Transport, Garda fraud and immigration bureaus, the joint body of local authorities and other bodies with the powers to prosecute
