Clare Cllr Confirms Tenant Repaid In RTB Case And Calls For Fair And Transparent Dispute System

A Clare councillor who was ordered to repay a tenant over five thousand euro in overpaid rent has confirmed the money has been refunded in full, while calling for a review of the RTB tribunal process.

The Residential Tenancies Board ordered Councillor Rita McInerney to repay tenant Bartosz Milinski €5,100 after ruling that a rent review notice served in March last year was invalid.

The notice sought to increase the monthly rent on a five-bedroom ensuite property in Doonbeg from 650 euro, where it had remained since 2019, to €1,500.

Speaking to Clare FM, Cllr McInerney questioned the comparable properties used in assessing the proposed increase, saying a nearby three-bedroom property was renting for €1,750 a month, but was not used as a comparison.

She’s calling on the Board to clarify how comparable properties are selected in its tribunal process.
