Man Jailed For Six Months Following Assault On Brother

A serving garda lost three teeth and was covered in blood as a result of what was described as a 'frenzied attack' by his brother.

Andrew Mc Namara of Ardnaculla, Ennistymon has been jailed for six months for assault causing harm to his brother Jim in June last year.

51 year-old Garda Jim Mc Namara was off-duty on June 17th last year when he travelled with his 13 year-old son to his parents' home, where his brother Andrew lives.

The Garda said Andrew was agitated on their arrival, following which he "punched with a closed fist" and head-butted Jim, and when he fell to his knees, caught him in a headlock and kneed him "in the face continually".

Garda McNamara said his son was crying uncontrollably and that his brother apologised but said he "had it coming to him."

Ennis District Court heard that Andrew McNamara has 24 previous convictions including four for assault and was jailed for five months in 2013 for an assault.

Judge Gráinne O'Neill said "the number of previous convictions display a propensity towards violence".

She imposed a six month jail sentence on Andrwe McNamara for assault causing harm to Garda McNamara as well as a two month prison term to run concurrently for a separate assault carried out on a second brother, Frank McNamara at the family home last October.
