This hearing arises from appeal lodged by the Director of Public Prosecution following the sentencing of Harry Dinan, of Waterpark Heights, Ennis and his nephew Kevin Dinan of Clarehill for the death of Brian Casey.

They were jailed for five and four years respectively for killing the young school teacher at O’Connell Square, Ennis on St. Stephen’s night 2009.

In December of last year – the Court of Criminal Appeal granted the DPP’s request – and ruled the sentences handed down in the case were insufficient.

Mr Justice Liam McKechnie described the attack on Mr Casey as cowardly and reprehensible and found the sentencing judge had made a mistake  in twice, giving the Dinans credit for the  fact this was a ‘one punch’ type case and thus reducing their sentences.
