Woman Who Secured Removal Of Husband From Family Home After Alleging ‘Hard Slipper’ NYE Assault Withdraws Interim Barring Order Application

A woman who last week secured a court order for the immediate removal of her husband from the family home after alleging that he beat her over the head continuously with a hard slipper on New Year’s Eve has now withdrawn her Interim Barring Order.

At the Family Law Court in Ennis last week, Judge Alec Gabbett granted the woman an Interim Barring Order (IBO) which required the man to leave the home forthwith.

The woman told Judge Gabbett: “I have been suffering a lot for many years and I was quiet because my kids were too young – now they are grown up and see everything.”

She said: “My husband has anger issues and for many years I have been facing domestic violence including verbal and physical abuse.”

The husband disputes all allegations made by his wife.

Judge Gabbett said that in the woman’s information grounding her application to court for the IBO, she said that her husband “has threatened to kill me and I had to plead with him not to kill me, pulls my hair, verbally abuses and calls me a bitch in front of the children”.

In her information the woman said that she had “no access to money and to bank accounts”.

She said that her husband has told her that she “has no right to money”.

The woman told Judge Gabbett: “He is an abuser to his wife – not to his kids.”

“He is a loving father and he is a caring father but I don’t think that he is caring or loving because no doubt he fulfils all his kids requirements but in front of them he beats me.”

She said that her husband beat her over the head continuously with a hard slipper on December 31st.

Asked by Judge Gabbett has she ever had to attend hospital after her husband’s assaults, the woman replied “no, but many times I got bruises on my body and my face as well and sometimes he beats me with his hard slippers, sometimes with his hands and once he raised a very big knife on me”,

Judge Gabbett adjourned the case to this week to allow the man contest or consent to the IBO.

Solicitor for the man, Caroline Doherty of Cahir and Solicitors Co LLP told Judge Mary Cashin at the Family Law Court in Ennis at the adjourned date that her client denies all of the allegations made.

In court, solicitor for the woman, Colum Doherty said that the parties have agreed written terms for the IBO to be withdrawn and asked Judge Cashin that the terms be placed on the court file.

However Judge Cashin stated that unless that the man was prepared to give sworn undertakings in court on the terms provided, she didn’t think it appropriate to place the terms on the court file.

Judge Cashin told the man that he needs to be advised that she has the same power as High Court judge in such circumstances where she could put him in prison if there is a breach of undertakings provided in court and he is found to be in contempt.

Ms Doherty said that her client is happy to comply with any conditions to allow the couple to resume their martial life.

Ms Doherty said that her client would have concerns about providing an undertaking in court as he currently has a visa application to be decided upon.

Judge Cashin said: “From my perspective if the IBO application is being withdrawn and the IBO being vacated that is the end of it.”

Judge Cashin told the woman that she no longer has court protection if the IBO is withdrawn but she can come to court in the future to seek any other order.

Mr Doherty said that his client’s preference was to keep the terms of the agreement private and not place them on the court file and the IBO proceedings are withdrawn.
