Truck Driver Appears In Connection With Crash That Claimed Life Of Crusheen Publican

A truck driver has appeared in court charged with the dangerous driving causing the death of father of three and Crusheen publican, Michael Fogarty last June.

At Ennis District Court, Paul Van Tamlin (55) appeared in connection with the fatal crash at Junction 13 on the motorway linking Galway to Limerick on June 5th last.

Mr Fogarty – who had a long involvement with the GAA and also worked as a milkman – was driving his 06- registered red Ford Transit van when it collided with a 08-registered white Volvo articulated truck being driven by Mr Van Tamlin at the exit from the motorway to Tulla at 12.50 on the Tuesday afternoon.

Sgt Aiden Lonergan told Judge Patrick Durcan that the case would be proceeding on indictment to the circuit court.

In the case, UK national, Mr Van Tamlin of Lough Ramor Camping Caravan Park, Virginia, Co Cavan has been charged with driving a vehicle, including speed, that was dangerous to the public causing the death of Michael Fogarty on the date.

Mr Van Tamlin is charged contrary to Section 53 of the Road Traffic Act.

Sgt Lonergan applied for an adjournment to allow a Book of Evidence be prepared in the case and said that Gardai had agreed bail conditions with Mr Van Tamlin.

As part of bail conditions Gardai sought that Mr Van Tamlin’s UK passport be surrendered.

In response, Judge Durcan told the Gardai: “You must have a very negative view of Mrs May’s ability to get Brexit over the bar.”

The bail conditions also specify that Mr Van Tamlin is to sign on at Bailleborough Garda station every Tuesday and be of good character.

Judge Durcan remanded Mr Van Tamlin on bail on his own bond of €100 to March 27th to Ennis District Court for the serving of the Book of Evidence.
