The former Anglo chairman is seeking to overturn the decision by Judge Martin Nolan a fortnight ago not to postpone his trial – due to negative publicity.
Sean Fitzpatrick is due to go on trial in October for 27 offences under the Companies Act– he’s denied making misleading, false or deceptive statements and furnishing false information between 2002 and 2007.
Two weeks ago, Judge Martin Nolan ruled that the trial could go ahead, despite an application by lawyers for the 66 year old for the trial to be postponed due to adverse publicity surrounding another trial of 3 Anglo officials.
In the High Court this morning, Judge John Hedigan said the judicial review could be heard next Friday, and adjourned the matter until then.
Lawyers for the DPP said they would be seeking reporting restrictions on the 28th of August.
While counsel for Mr Fitzpatrick, who was not in court, said his client had already suffered a deluge of bad publicity.
