‘Open Disclosure’ Legislation Needed Following Clare Woman’s Case Says Lawyer

The legal firm representing a Clare woman who sued the HSE and was awarded a six figure settlement this week says open disclosure legislation is needed as a priority.

Rebecca Collins gave birth to a stillborn baby at University Maternity Hospital Limerick 16 years ago.

She sued for allegations of medical negligence, a breach of duty of care and medical mismanagement, with the HSE admitting liability and a failure in its duty of candor.

The HSE has apologised and says “they are committed to ensuring that the recommendations identified by this investigation report are implemented as a matter of urgency”.

Rachael O’Shaughnessy, who’s Partner with Homs Assist, the legal firm which represented Rebecca Collins, says mandatory open disclosure for cases like this is needed.
