O’Brien Disappointed By Failed Legal Action Against Dail Statements

Denis O’Brien says he’s disappointed by his failed legal action over statements made by two TDs in the Dáil about his banking affairs.

In a statement issued this afternoon, the businessman said he has yet to decide whether he intends to appeal.
Through this action, Denis O’Brien was effectively asking Ms. Justice Una Ní Raifeartaigh to reprimand Social Democrats TD Catherine Murphy and Sinn Féin’s Pearse Doherty for revealing some of his dealings with the IBRC while an injunction preventing RTÉ from doing so was in place.

He sought a number of declarations including one to say the defendants were guilty of an unwarranted interference in the operation of the courts.

In a nutshell, Justice Ní Raifeartaigh decided she was prevented from interfering because of the absolute privilege enjoyed by TDs and Senators under the Irish Constitution.

However, she did note that his case throws a light on the need for a general examination of this area.

That suggestion was wholly welcomed by Mr. O’Brien, but Deputy Murphy took a more cautioned approach to it

Mr. O’Brien has said he intends to study the 106-page judgement in detail before deciding whether to appeal.
