The High Court has given the go ahead for a North Clare Engineer to challenge the planning permission granted to Supermac’s owner Pat McDonagh for the development of a €10m motorway plaza on the outskirts of Ennis.

According to the Irish Examiner, Mr Justice Richard Humphreys delivered a written judgement to Kilfenora man, Michael Duffy saying he was prepared to grant him permission to seek to overturn An Bórd Pleanála’s 2022 decision.

The previous decision from the board gave Mr McDonagh approval for the development of a service station and rest stop area on the M18 Motorway near Kilbreckan, Doora.

As part of his action, Mr Duffy claims that the board did not conduct any Appropriate Assessments to determine that wastewater from the proposed development would not impact on any designated Special Areas of Conservation.

The matter will return before the courts at a later date.
