Leading Academic Says Clare Legal Case Has ‘Consequences’ For Every Local Authority

A leading academic says a Supreme Court ruling in the case of a Traveller family in Clare has ramifications for every local authority in the country.

The Court upheld an appeal by the McDonagh family earlier this week relating to their unathorised presence on a site owned by Clare County Council.

The local authority did not provide the family with appropriate accommodation elsewhere, with the ruling suggesting it is for a Council to convince courts in future cases that they have fulfilled their obligations.

Dr Padraic Kenna, who’s Director of the Centre for Housing Law, Rights and Policy at NUI Galway, says the ruling does not apply to private land.
