Judge Tells Warring West Clare Brothers That Parents Would Be “Turning In Their Graves”

A judge has told two warring west Clare brothers that their deceased parents "would be turning in their graves" if they knew the two of them were in court.

60-year old Daniel Hayes and his 64 year old brother Michael, both of Carnanes, Kilrush, have appeared before Kilrush District Court in relation to an incident one year ago.

Daniel Hayes lives by himself in Carnanes, Kilrush on lands adjacent to the farm owned by his brother Michael, who is married with a family.

60-year old Daniel is accused of assaulting his brother at Carnanes, Kilrush on October 14th last year, and also of the criminal damage of Michael Hayes's tractor.

64 year old Michael was before the court accused of the criminal damage of the rear window of Daniel’s silver Land Rover. 

They both deny the charges.

Garda Niall Donegan told the court of “ongoing friction between the two brothers” and outlined how an argument had ensued after a stone was thrown through the window of Daniel's jeep.

The Garda also outlined how he was told by Michael Hayes that Daniel had thrown a stone at him, hitting the back of his head and the windscreen of his tractor.

Judge Patrick Durcan intervened in the case following Garda evidence, saying that "this is not a case that should be wasting and taking up the time of the court".

He adjourned the case until April 19th of next year, warning that "if there is any cause for the Gardai to be called" because of these people, he wanted Gardai to re-enter the case.
