Judge Patrick Durcan – who initially comments last month- raised national awareness of the 52 year old’s case  – added it was "shamefully sad" the Mr Pavelka died in the "circumstances and conditions that he did."

Josef Pavelka – who died in a lane way at the rear of Supermacs on O’Connell Street last Saturday night was due to appear at Ennis District Court yesterday.

When his name was called – Judge Patrick Durcan repeated his views that in a modern democracy where someone ends up sleeping in a public toilet "is and always will be a scandal."

Describing Josef Pavelka as a "kindly gentleman" when ever he appeared before the courts – judge Durcan stated that despite his difficulties, and his inability to deal with his problems – the 52 year old’s life here was something which is a matter that nobody here can be proud.

Judge Durkan added that out of all the bad stories – good may come and hoped that people who are involved in the care of others as well as members of the public would try to ensure that no one ,in their knowledge, ends up living in those conditions.

Meanwhile,

A vigil is set to be held tonight in memory of Joseph Pavelka.

The event is taking place in the Square in Ennis Town Centre at 7 pm close to where the 52 year old was found dead.
