A major hospital has told a senior Garda that it is “100pc likely” that a hospital patient report on an alleged victim in a false imprisonment and assault causing harm case will be ready for court on Tuesday.
That is according to Det Sgt Kevin O’Hagan of Shannon Garda Station who told Ennis Circuit Court that University Hospital Limerick (UHL) has told him that a patient report by a hospital can be up to 50 pages long for a patient after a two week stay.
Det Sgt O’Hagan told the court that he has been told by the hospital that it is ‘100pc likely’ that the report will be complete for court on Tuesday.
Last week at Ennis Circuit Court, Judge Francis Comerford granted an adjournment in the case of Mark Hayes (35) who is charged with false imprisonment of his then girl-friend at a house at Rineanna View in Shannon on March 17th last contrary to Section 15 of the Non Fatal Offences against the Person Act.
Judge Comerford granted the adjournment as the patient report was not yet available to the court.
Mr Hayes of Aidan Park, Shannon is also charged with the assault causing harm of the same woman at the same Shannon address of Rineanna View contrary to Section 3 of the Non-Fatal Offences Against the Person Act on March 17th.
Mr Hayes is also charged with threatening to kill his then girlfriend at the same address on the same date contrary to Section 5 of the Non Fatal Offences against the Person Act.
Det Sgt O’Hagan said that the alleged victim in the case was released from hospital on March 28th.
Counsel for the State, Sarah Jane Comerford BL (instructed by Clare State Solicitor, Aisling Casey) said: “We are hopeful that the report will be before the court on Tuesday and the court can see that all efforts have been made and are being made to obtain the report.”
Ms Comerford said that the State hopes to proceed with the trial on Tuesday.
Judge Comerford said that he would give the case priority on Tuesday.
