A fresh prosecution has been launched arising out of an incident at an Ennis primary school this year, in which a man is alleged to have produced a slash hook.
Conor Mahon, of Ballaghboy halting site, Quin Rd, Ennis faces two charges relating to the incident, which occurred at the Holy Family Junior School on March 20th.
Charges against Conor Mahon and two others, arising out of the March disturbance, were struck out in June over the DPP’s failure to provide directions in the case after a number of court adjournments.
At that point, Judge Patrick Durcan said this didn’t "prevent the state from coming again" and last evening, the 21-year old appeared before Ennis District Court, facing two fresh charges of violent disorder and possession of a slash hook.
The alleged offence is contrary to Section 11 of the Firearms and Offensive Weapons Act.
InspTom Kennedy said told the court that the DPP has instructed that the case proceed on indictment to Ennis Circuit Court, but Mr Mahon’s solicitor, Darragh Hassett said “the State is having a second bite of the cherry in the case”.
Judge Durcan granted legal aid in the case and remanded Mr Mahon on bail to re-appear in court on November 14th next for the serving of the Book of Evidence in the case.
