Éir has lodged an appeal with An Bord Pleanala, after a planning application for a 30m-high telecoms mast in East Clare was denied.
The communications company lodged the initial application for the site in Newmarket-on-Fergus to boost coverage in the area.
Éircom Ltd, trading as Éir lodged the initial application with Clare County Council in November 2022.
The application sought to remove an existing 12m mast and replace it with a 30m high telecoms tower at the site in Ballynacragga, Newmarket-on-Fergus.
The company states that the existing infrastructure is inadequate to fulfill the current and future demand in the area.
Local objections cited concerns over the close proximity of the development to houses in the area.
Clare County Council denied permission due to the potential impact on local residents, the height of the development and the failure to adequately explain why an alternative site could not be used.
Éir has now lodged an appeal with An Bord Pleanala, with the case due to be decided by June 19th.
