The DPP has moved to appeal the sentence handed down to a man who raped his ex-girlfriend while she slept in an apartment they shared in Dublin.
Last July, Magnus Meyer Hustveit was sentenced to seven years in prison but it was suspended in full.
Magnus Meyer Hustveit, a 25-year-old IT worker, now lives in his native Norway with his girlfriend and her two children.
But in May 2011, he was living in Dublin when he met Niamh Ní Dhomnaill in a city centre bar. The couple moved in together a few months later.
After suspecting he was having sex with her while she slept, Niamh confronted him, and he admitted everything in a lengthy Email used as evidence.
Last July, he was handed a seven year sentence, but it was suspended in full, and the DPP believes the judge erred in principle by not taking into account the breach of trust, the fact it happened many times over a long period and the impact it had on his victim.
His lawyers believe the original decision was correct because he openly provided the information that led to his prosecution, an exceptional circumstance that warranted the sentence being suspended in full.
The three-judge panel has reserved its judgement.
