DPP Decides Against Prosecution Of Two Parents Accused Of Sexually Abusing Their Children

The DPP has decided not to prosecute two parents accused of sexually abusing their children.

Two of their children, now aged 6 and 9, are at the centre of a legal battle between their foster parents and Tusla.

The children’s foster parents initiated these legal proceedings after Tusla withdrew its application for permanent care orders in May.

They want the children to be made wards of court, and they also want the court to carry out a full inquiry before deciding whether they should be returned to their family home.

The children were due to be returned last month, but an interim order was made to allow them stay with their foster parents until this action is finalised.

This morning, Ms. Justice Marie Baker was told the DPP has decided not to pursue a case against the parents.
All parties agree that it has no bearing on the decision the court has to make in this instance.

Ms. Justice Baker just has to decide whether she has the jurisdiction to make them wards of court and whether it is an appropriate course of action.

Tusla will be given an opportunity to respond at some stage this afternoon.
