The Disclosures Tribunal has heard that Maurice McCabe was confronted by two members of the D family in 2007, causing him to run into Bailieboro Garda station to avoid any trouble.
Ms D alleged she was sexually assaulted by the Garda Whistleblower in 2006, the DPP decided the following year that there was no basis for prosecution.
The Tribunal has heard Maurice McCabe wanted the full direction of the DPP to be made known, as it exonerated him completely.
Superintendent Noel Cunningham is before the Disclosures Tribunal again today, where he’s been facing questions about a complaint made by Maurice McCabe against Mr D in 2008.
Mr D’s daughter, who’s referred to as Ms D to protect her identity, accused Sergeant McCabe of sexual abuse in 2006. The DPP ruled the following year that the case did not warrant a prosecution.
It’s now emerged that in February 2008, then Inspector Noel Cunningham was asked to investigate a complaint against Mr D.
Inspector Cunningham did not want to investigate the matter, having already investigated a complaint made by Ms D, and because he knew both parties, but he was directed to do so.
The Tribunal heard that Sgt McCabe was confronted by two members of the D family, causing him to run into Bailieboro Garda Station to avoid any trouble.
The Tribunal has also heard that there were interpersonal difficulties at Bailieboro Garda Station – and that Maurice McCabe wished the DPP’s full direction regarding its decision not to prosecute him to be made known.
The DPP said the incident described by Ms D did not constitute a sexual assault or indeed an assault.
Superintendent Noel Cunningham says he only told the D family that that DPPs direction was not to prosecute based on a lack of evidence, as per the DPP’s guidelines.
