Court To Rule In Patrick Barry Appeal

An 80 year old former West Clare school principal will learn the verdict of his appeal against his conviction for the sexual assaults of former pupils today.

Patrick Barry of Well Road, Kilkee is serving six years behind bars after he was found guilty of the offences over a 21-year-period.

In November of last year, Patrick Barry was handed an 11 year jail term after he was found guilty on 59 counts of indecent assault against 11 pupils of Moyasta National School on dates between 1964 and 1985.

Judge Gerald Keyes suspended the final five years of the sentence because of Barry’s age and poor health.

Barry's lawyers appealed his conviction in the Court of Appeal on grounds that particulars on the indictment against him did not correspond to relevant counts.

They further submitted that the prosecution’s failure to provide details of people interviewed by gardaí who did not go on to make complaints had prejudiced their client

The Court of Criminal Appeal is due to issue its judgement in the case later today.
