Gerry Walshe of Lisdeen Road, Kilkee is one of two people who have brought legal arguments against the outcomes of the referendum.
The High Court dismissed both cases but they are now due to be heard by the Court of Appeal on July 30th.
The government had hoped to publish the legislation to enact the result of the referendum before the Dail rises in July, but the ongoing legal situation means same sex marriage is likely to be delayed.
