The High Court is today due to hear a Co Clare doctor's challenge to the introduction of free GP care for Under-6s.
The scheme is due to be rolled out in the next few weeks.
But one GP with a practice in Shannon is loathed to sign up to the scheme and is taking the HSE to court.
Dr. Yvonne Williams fears the new arrangements will lead to a dramatic increase in the frequency of visits by children under six and that this will compromise patient care.
However she claims if she doesn't sign up to the new contract patients with young children will go elsewhere putting a practice with 5 staff members in jeopardy.
Dr Williams, supported by the National Association of General Practitioners, is seeking an injunction against the HSE to stop the terms of her existing contract being amended.
Mr Justice Tony Hunt will hear the application today.
