Clare Couple Call For End To Surrogacy Legislation Delays

A West Clare couple are calling for an end to delays in legislating on the issue of surrogacy.

Fiona Whyte and Seán Malone, whose three-year-old twins were born to a surrogate in India, have had a long legal battle to be recognised as their parents.

Fiona has no genetic connection to the children, and as the law currently stands, the surrogate is considered to be their legal mother.

Because of the gap in Irish law, Fiona had to go to the courts to secure guardianship of the twins, and did so in a landmark ruling last month.

Speaking to Clare FM’s Fiona McGarry as part of a Morning Focus feature, she said the current situation discriminates against her family:
