The High Court has ruled that a five day old infant is lawfully in the care of the HSE.
The baby boy was the subject of an emergency care order in the District Court last Thursday mostly over concerns about the alleged anger, aggressiveness, volatility and potential violence of his father.
The mother claims that on her discharge from hospital the family were confronted by gardai and in effect put under house arrest while the HSE went to court.
Mr Justice Sean Ryan has found the mother did not have a proper opportunity to address this most serious case, but ruled that her right to fair procedures is outweighed by her baby’s immediate protection needs.
