Former Clare GP Loses Appeal For Legal Costs

A former East Clare GP has lost out in his efforts to secure legal costs against the State in respect of a long-running courts battle to clear his name.

68 year old Paschal Carmody of Ballycuggeran, Killaloe has claimed that he spent up to 3 million euro proving his innocence of charges of false pretenses and deception.

It had been alleged that Mr. Carmody obtained money from two terminally ill cancer patients, but in 2012 he was acquitted at Ennis Circuit Court during a third trial.

At the Circuit Criminal Court yesterday, he was refused costs by Mr. Justice Raymond Fullam on the basis that he had waited four years before applying for them, and on grounds that the court could not re-open an issue after a final order was made.
