Insp Tom Kennedy told Ennis District Court the aircraft parked in the middle of the airfield at Shannon airport on April 25th last had been damaged by the slogan type material scrawled on it.

Insp Kennedy said that it will be alleged the two accused circumvented the security to write the slogan.

They charged with causing criminal damage without lawful excuse by defacing a US navy aircraft with graffiti.

Judge Durcan declined jurisdiction in the cases and will transfer the case to the circuit court for July 19th.

In the district court, persons convicted of criminal damage can face jail terms up to 12 months but this to up to 10 years in the circuit court.

As part of Dr Horgan’s bail conditions, Judge Durcan ordered that he not go within 5km of Shannon airport.

He argued that this condition infringed on his constitutional rights and he was opposing it and said he would be appealing the bail condition to the High Court.
